Privacy policy

We ask only for what we need to cook your order, deliver it and take payment. Nothing more, and we never sell any of it on.

Data controller

What we keep

When you order, we keep the following:

• Your name, so the courier knows who to ask for.
• Your phone number and email address, to reach you about this order.
• Your delivery address and any directions for the courier.
• What you ordered, your notes for the kitchen and the time.
• The amount, the payment status and Mollie’s reference — never your card number.
• Your language choice and the contents of your basket, held locally in your browser.

What we use it for

To prepare your order, deliver it and take payment, to call you if something goes wrong at the door, and to keep our books as the law requires. We do not send marketing to an address you give us when ordering unless you ask for it separately.

Legal basis

Performance of the contract we enter into when you order (article 6(1)(b) GDPR), our legal obligations on bookkeeping and VAT (article 6(1)(c) GDPR), and our legitimate interest in preventing fraud and abuse (article 6(1)(f) GDPR).

Who else sees your data

Mollie B.V. processes your payment. Our hosting partner runs the website inside the European Union. The courier on your run sees your name, address, phone number and order, and nothing else. All of them may use your data only to do their job. We do not sell your data and we do not share it with advertisers.

How long we keep it

Order records and invoices are kept for seven years, because Belgian accounting law requires it. Your phone number, address and notes disappear from our ordering system 90 days after delivery. What sits in your browser — language and basket — you clear yourself by clearing your browser data.

Your rights

Under the GDPR you have these rights. Email hallo@smashcheatburger.be and we act within a month:

• Access to the data we hold about you.
• Correction of anything that is wrong.
• Erasure of anything we are not legally required to keep.
• Objection to processing based on legitimate interest.
• A copy of your data in a readable file.
• A complaint to the Belgian Data Protection Authority, Drukpersstraat 35, 1000 Brussels (dataprotectionauthority.be).

Cookies

We use functional storage only: your language choice and the contents of your basket, kept in your own browser. No advertising cookies, no third-party trackers, no profiling. That is why there is no banner here for you to dismiss.
